Building Control Services

Terms & Conditions

The Client agrees that:

  • jhai ltd will act as agent for the Client only for the purposes of signing the Initial Notice.
  • The Approved Inspector will provide the services in the Schedule of Services.
  • The Client appoints the Approved Inspector and the Approved Inspector accepts the appointment for the project
  • The Client shall pay the Approved Inspector the agreed fee within 30 days of the date stated on the relevant invoice(s) unless an alternative agreement is made.
  • The Approved Inspector will maintain an insurance scheme approved by the Department for Communities and Local Government in accordance with the Building Act 1984.
  • The liability of the Approved Inspector will be limited to that of Local Authority Building Control under Murphy v Brentwood District Council

Schedule of Services

jhai ltd shall at all times operate within the Code of Conduct for Approved Inspectors produced by the Construction Industry Council.

jhai ltd shall be responsible for:

  • Serving the Initial Notice on the Local Authority.
  • Checking plans and information provided for compliance with the Building Regulations.
  • Advising the Client or Client’s agent of any additional information required to assess the plans for compliance with the Building Regulations
  • Consultation with the Fire Authority.
  • Maintaining records of plan assessment and, where guidance other than guidance within the Approved Documents is followed, providing a copy for the Client if requested.
  • Undertaking site inspections of work in progress and at completion to ensure that as far as reasonably possible the works satisfy the Requirements of the Building Regulations.
  • Issuing the Final Certificate to the Local Authority and copying to the Client

Note: For new dwellings it is required that the developer has a link warranty in place upon completion. For more information please contact your Project Manager.

Fees

  • All fees will be invoiced in accordance with the quotation document issued. Generally, plan fees are invoiced upon receipt of the submission and inspection fees will be invoiced as works commence on site.
  • All fees stated on the quotation are exclusive of VAT unless otherwise stated.
  • Invoices should be settled within 30 days from the date of invoice.
  • jhai ltd reserves the right to terminate the contract unless fees have been paid in full or in accordance with any agreements arranged.

jhai ltd will complete the following on all projects:

Pre-submission checking:

We can discuss aspects of your proposal prior to application either on site or at your office. We can look at projects at scheme design or planning stage if requested.

Plan check

If required the plan check will assess compliance with the Building Regulations and we may also offer advice in connection with related legislation.  We have in-house experts in the following areas for consultation.

  • Structural engineering
  • Fire safety advice and fire engineering
  • Accessibility for disabled people and Inclusive Design
  • Sustainable design and development
  • Energy conservation

Please note that our in-house fire engineers, our sustainability manager and inclusive design team may be consulted as a matter of course at no additional cost to you. It is our experience that this input can add significant value to the design and project management team.

We also offer additional services where these might be appropriate to a particular project.  These include consultancy relating to the Disability Discrimination Act (Equality Act 2010), the Regulatory Reform (Fire Safety) Order and the Code for Sustainable Homes.

Engagement of any consultant can be made via your Project Manager.

Building Regulations Approval

It is always wise to ensure that any plans are checked for conformity with the regulations. This Approval can be Conditional or in agreed stages. All but the most straightforward work will require an application to be approved subject to some conditions. Normally, approval of space and water heating systems and electrical installations will require third party accreditation.

Site inspections

We will carry out periodic inspections appropriate to the type of project as outlined below.  However, you must let us know when you require the following inspections:

  • Commencement and excavation works
  • Oversite and drainage works
  • Roof structure
  • Completion – see below.

The Project Manager will normally agree an inspection plan with you upon the commencement of works. You or your representative may request a meeting on site or elsewhere to discuss the project. Please note we require 24 hours notice, although if possible we will visit the site the same day.

Notification of construction phases agreed in the inspection plan can be given by contacting your local office by phone, e-mail, fax or post. If you don’t know which your local office is please telephone 01308 428020, email: info@jhai.co.uk or visit www.jhai.co.uk

All inspections are recorded in writing on site. Such records are signed by a responsible person, typically the site agent or manager. A verbal report can also be given to the client or his representative. Written confirmation will be left on site if possible or forwarded within 48 hours. 

The Site Inspection Sheet includes date, (and time if material,) site address, application number, name of surveyor and name and capacity (such as the Fire Service) of any person accompanying the inspection. It also states the works viewed and comments are made regarding their adequacy or otherwise.  Any items unresolved, subject to dispute or found unsatisfactory will be immediately communicated to the contractor, client, or the client’s representative. Electronic records of all site inspections can be made available to the design team or client upon request.

Completion

A Final inspection can be carried out within 24 hours of notification of completion of the works.

Fire systems including emergency lighting, fire alarms and signage should be tested throughout. Normal NICEIC installation and commissioning certificates or amendments must be provided by contractors at completion.

Installers / designers / manufacturers of other systems, such as air-handling units, boilers and flues are also required to provide suitable evidence of compliance with relevant legislation or standards.

A verbal completion report can be provided to the client or his representative on site. A Final Certificate will be issued following a satisfactory Final inspection and submission of compliance evidence referenced above.

Energy Assessments

Terms & Conditions

By signing the Project Information Sheet or Instruction Form the Client agrees that:

  • jhai ltd will provide the services in the Schedule of Services.
  • The Client appoints jhai and jhai accepts the appointment for the project
  • The Client shall pay jhai the agreed fee within 30 days of the date stated on the relevant invoice(s) unless an alternative agreement is made.
  • jhai ltd will maintain a professional liability insurance scheme.
  • jhai ltd reserves the right to charge for additional work incurred by significant changes in the design, if for instance the floor area or heating system changes. Minor changes will be accommodated free of charge.

Schedule of Services

jhai ltd shall be responsible for:

  • Preparing the calculation based upon the information provided by the client.
  • Advising the client or client’s agent of any additional information required to prepare the energy assessment.
  • When a calculation shows non-compliance with statute or guidance, jhai will suggest measures to achieve compliance.
  • Maintaining records of energy assessment and, where guidance other than traditional compliance is followed, providing a copy for the Client if requested.
  • If instructed to do so by the client, jhai will, subject to an appropriate charge, attend site inspections of work in progress and at completion to ensure that as far as reasonably possible the works satisfy the requirements of prepared calculation.
  • Providing certification of the result of the energy assessment to the client.

Fees

  • All fees will be invoiced in accordance with the quotation document issued. Generally fees will be invoiced upon receipt of instruction via the project information sheet. However we can accommodate stage payments if requested. No certificates will be issued until payment has been received unless agreed otherwise with your Project Manager.
  • In the case of air leakage testing, the fee will be invoiced as soon as is practicable to suit your work schedule. A re-test fee will be charged if the test fails and jhai incurs additional cost.
  • All fees stated on the quotation are exclusive of VAT unless otherwise stated.
  • Invoices should be settled within 30 days from the date of invoice.
  • jhai ltd reserves the right to terminate the contract unless fees have been paid in full or in accordance with any agreements arranged.
  • Air/ Sound Testing booking and cancellation policy:
     
    Our quoted fees are to complete the number of Air Tightness/ Sound Tests stated, based on the testing being carried out between 8am and 4pm, Monday to Friday. Should testing be required outside of these times this can be arranged (subject to availability) but will incur additional charges, details of which are available on request.
     
    Please note; we reserve the right to make the following charges in the case of the events listed: Plots not ready when the test engineer arrives (testing not able to be performed) – full charge; cancellation or postponement of the test(s) with less than 48 hours’ notice – 50% of charge; cancellation or postponement of the test(s) with less than 24 hours’ notice – full charge.
    We do understand that delays occur on site, so we kindly ask that you ensure you give as much notice of changes as possible in order to avoid unnecessary charges.

The following Energy Assessment services are available:

SAP Calculations & EPC – Applicable to New Build, Material Change of Use and Substantially Glazed Extensions

 jhai ltd will require the following information:

  • DWG format drawings are preferred, but pdf’s or hard copy scalable plans are acceptable.
  • Full Specifications

jhai ltd will provide:

  • Dwelling modelled in SAP program with U-values calculated.
  • Design Stage calculation produced and suggested measures to achieve compliance.
  • Accommodation of minor changes and modifications
  • As-built SAP calculation produced on confirmation of construction and air test certificate
  • EPC issued

SBEM Calculations & EPC –Applicable to buildings other than dwellings- New Build and Large Extensions

jhai ltd will require the following information:

  • DWG format drawings are preferred, but pdf’s or hard copy scalable plans are acceptable.
  • Full Specifications (including U-values, heating systems, etc)

jhai ltd will provide:

  • Dwelling modelled in SBEM program with U-values calculated.
  • Design Stage calculation produced and suggested measures to achieve compliance.
  • Accommodation of minor changes and modifications
  • As-built SBEM calculation produced on confirmation of construction and air test certificate
  • EPC issued

Notes to SAP and SBEM:

  • Please note that building control will require certification of an approved completed design stage calculation at least one day before work starts on site.
  • jhai ltd can, if requested, produce a checklist of minimum general specifications to which the building is to be constructed.
  • It should also be noted that a building control body will require a post construction Energy Performance certificate not more than five days after the work has been completed. Failure to produce this could delay the final Building Control sign off.

Code for Sustainable Homes (C4SH)

jhai ltd will require the following information:

  • DWG format drawings are preferred, but pdf’s or hard copy scalable plans are also acceptable.
  • Full code specifications (including third party accreditation information, U values, heating systems, etc)
  • Target code rating to be achieved. Any inadequacies or deficiencies relevant to achieving this standard will be reported and information returned to suggest how compliance might be achieved.

jhai ltd will provide:

  • Attendance at pre-assessment meetings and provision of advice and reports as required.
  • Site registration with C4SH licensing body
  • The design stage assessment
  • The post construction calculation,
  • Quality Assurance undertaken by licensing organisation.

Notes to C4SH:

  • Timescales will be dependent on the project and the quality of information provided.
  • Your Project Manager will be able to tell you what is required and when. Please make every effort to provide the correct information.

Sound Insulation Testing

To assess the project jhai ltd will require the following information:

  • Specifications and drawings. DWG format drawings are preferred, but pdf’s or hard copy scalable plans are also acceptable.

jhai ltd will provide:

  • The relevant tests at pre-completion stage.
  • An appointment to undertake the test within 7 Working days notice from the client.

Notes to Sound Insulation testing:

  • Doors should be hung
  • Windows and trickle ventilation should be fitted
  • Laminate flooring is acceptable but there should be no carpets or soft furniture
  • 240 V power should be available on site
  • During the test, the building should be quiet so that results are not adversely affected.

Air Tightness Testing

To assess the project jhai ltd will require the following information:

  • Specifications and drawings. DWG format drawings are preferred, but pdf’s or hard copy scalable plans are acceptable.
  • A copy of the SAP worksheet or air design permeability figures.

Notes to Air Tightness Testing:

  • The following conditions are required before a test can be undertaken:
  • Doors should be hung
  • Windows and trickle vents should be fitted.
  • Power should be available on site (110 or 240V)
  • All gaps and openings should be sealed.

Planning and Sustainability Services

By signing the Project Information Sheet or Instruction Form, the Client agrees that:

  • jhai ltd will provide the services in the Schedule of Services.
  • The Client appoints jhai and jhai accepts the appointment for the project
  • The Client shall pay jhai the agreed fee within 30 days of the date stated on the relevant invoice(s) unless an alternative agreement is made.
  • jhai ltd will maintain a professional liability insurance scheme.
  • jhai ltd reserves the right to charge for additional work incurred by significant changes in the design, if for instance Policy Requirements change. Minor changes will be accommodated free of charge.
  • Where acceptable or comprehensive project information is not available, further investigation, including a site survey, may be necessary. jhai ltd reserves the right to charge for such visits at a rate of £70.00 per hour plus reasonable travel costs.

Schedule of Services

jhai ltd shall be responsible for:

  • Preparing the report or necessary paperwork based upon the information provided by the client.
  • In its preparation of the report or necessary paperwork jhai will check the building from the plans and information provided by the client
  • Advising the client or client’s agent of any additional information required to prepare the report or necessary paperwork.
  • Suggesting generic measures to achieve compliance when a proposal shows non-compliance with a planning policy or guidance.
  • Maintaining records of the report or necessary paperwork and providing a copy for the Client.

Fees

  • All fees will be invoiced in accordance with the quotation document issued. Generally, plan fees are invoiced upon receipt of the submission and inspection fees will be invoiced as works commence on site.
  • No reports or necessary paperwork will be issued until payment has been received unless agreed otherwise with your Project Manager.
  • All fees stated on the quotation are exclusive of VAT unless otherwise stated.
  • Invoices should be settled within 30 days from the date of invoice.

Design and Access Statements for planning applications:

To assess the project jhai ltd will require the following information:

  • PDF (to scale) format drawings are preferred. Hard copy plans will are acceptable providing dimensions are clearly stated and/or scalable.
  • Any other document written or collected during the course of putting the planning application together.

jhai ltd will provide:

  • Full report for approval by client, ready for formal submission.
  • Minor changes and modifications will be accommodated free of charge.

Sustainability and BREEAM Report for planning applications:

To assess the project jhai ltd will require the following information:

  • PDF (to scale) format drawings are preferred. Hard copy plans will are acceptable providing dimensions are clearly stated and/or scalable.
  • Any other document written or collected during the course of putting the planning application together
  • Full Specifications (including U-values, heating systems, etc), where known.

jhai ltd will provide:

  • Review of relevant Planning policy to ensure that the proposal will comply.
  • A BREEAM pre-assessment estimation, if necessary, including attendance and advice at pre-assessment meetings as required.
  • Full report for approval by Client, ready for formal submission.
  • Minor changes and modifications will be accommodated free of charge.

Notes to Planning and Sustainability Services:

  • Clients are asked to approve contents of the Draft Report prior to release of Final Report. 
  • Timescales will be dependent on the complexity of the project and the quality of information provided.
  • Your Project Manager will be able to tell you what is required and when. Please make every effort to provide the correct information.

Fire Safety Services

By signing the Project Information Sheet or Instruction Form, the Client agrees that:

  • jhai ltd will provide the services in the schedule of services.
  • The Client appoints jhai and jhai accepts the appointment for the project
  • The Client shall pay jhai the agreed fee within 30 days of the date stated on the relevant invoice(s) unless an alternative agreement is made.
  • jhai ltd will maintain a professional liability insurance scheme.
  • The liability of jhai ltd will be limited to the information that it has provided with by the client.

Schedule of Services

jhai ltd shall at all times operate within the RICS Code of Conduct.

jhai ltd shall be responsible for:

  • Preparing the report or necessary paperwork based upon the information and /or plans provided by the client.
  • If a site visit is required, agreeing access arrangements with the client.
  • Advising the client or client’s agent of any additional information required to prepare the report or necessary paperwork.
  • Maintaining records of the report or necessary paperwork and providing a copy for the Client.

Fees

  • All fees will be invoiced in accordance with the quotation document received. Generally fees will be invoiced upon receipt of instruction via the project information sheet.
  • No reports or necessary paperwork will be issued until payment has been received unless agreed otherwise with your Project Manager.
  • All fees stated on the quotation are exclusive of VAT unless otherwise stated.
  • Invoices should be settled within 30 days from the date of invoice.

Fire Engineering/Consultancy Services:

To assess the project jhai ltd will require the following information:

  • PDF (to scale) format drawings are preferred. Hard copy plans will are acceptable providing dimensions are clearly stated and/or scalable.

 jhai ltd undertakes to provide:

  • Full report/calculations as required and appropriate for confirmation by client, ready for formal submission.
  • Minor changes and modifications made incorporated
  • jhai ltd will be happy to discuss the contents of the report with Building Control or fire authority at rates agreed with the client.

Fire Risk Assessments:

jhai will require the following information:

  • PDF or CAD format drawings are preferred but hard copy plans are acceptable providing dimensions are clearly stated and/or scalable.
  • Copies of statutory approvals and historical data relevant to the compliance with relevant fire legislation. For instance: previous fire certificates, correspondence from Fire Authority, Building Regs approvals etc. if available.
  • Full Specifications of passive and active systems, if available.
  • Design, Installation and Commissioning certificates for passive fire systems, i.e. emergency lighting, detection, alarm systems or sprinklers as appropriate.
  • Access to records showing frequency of testing and maintenance regimes

jhai ltd will provide:

  • Risk assessment of the environment based against a standard proforma.
  • Individual risks will be rated against a standard grid and suggested measures which may involve physical alteration, removal of material or management of issues will be suggested, depending on the risks presented.
  • Full report for confirmation by client.
  • Minor changes and modifications made will be incorporated

Notes to Fire Safety Services:

  • Timescales will be dependent on the project in question and the quality of information provided.
  • Your Project Manager will be able to tell you what is required and when. Please make every effort to provide the correct information.

Inclusive Design Services

By signing the Project Information Sheet or Instruction Form, the Client agrees that:

  • jhai ltd will provide the services in the Schedule of Services.
  • The Client appoints jhai and jhai accepts the appointment for the project
  • The Client shall pay jhai the agreed fee within 30 days of the date stated on the relevant invoice(s) unless an alternative agreement is made.
  • jhai ltd will maintain an insurance scheme that covers their professional liability.
  • jhai ltd reserves the right to charge for additional work incurred by significant changes in the design, if for instance the Policy Requirements change. Minor changes will be accommodated free of charge.

Schedule of Services

jhai ltd shall be responsible for:

  • Preparing the report or necessary paperwork based upon the information provided by the client.
  • In its preparation of the report or necessary paperwork jhai will check the building from the plans and information provided by the client
  • Advising the client or client’s agent of any additional information required to prepare the report or necessary paperwork.
  • When a proposal shows non-compliance with guidance, jhai will suggest measures to achieve compliance.
  • Maintaining records of the report or necessary paperwork and providing a copy for the Client.

Fees

  • All fees will be invoiced in accordance with the quotation document issued. Generally, plan fees are invoiced upon receipt of the submission and inspection fees will be invoiced as works commence on site.

Access Statements for Building Regulations applications and ROI Disability Access Certificate Reports:

To assess the project jhai ltd will require the following information:

  • DWG, PDF (to scale) format plans of proposed works are preferred. Hard copy plans will are acceptable providing dimensions are clearly stated and/or scalable.
  • Plans of existing buildings where available
  • Door schedules, door furniture and handrail details and surface finishing/ colour schedules where known
  • Details of the likely use of the building.

jhai ltd will provide:

  • Full report for approval by client, ready for formal submission.
  • Minor changes and modifications will be accommodated free of charge.
  • If insufficient information is available, a site visit may be required
  • Clients are asked to approve contents of the Draft Report prior to release of Final Report. 
  • Timescales will be dependent on the project in question and the quality of information provided.
  • Your Project Manager will be able to tell you what is required and when. Please make every effort to provide the correct information.

Access Audits:

To assess the project jhai ltd will require the following:

  • Plans of existing buildings where available.
  • Details of the existing/proposed use of the building.
  • Access to all relevant areas of site
  • Permission to take photographs on site

jhai ltd undertakes to provide:

  • Full report for approval by client.
  • Minor changes and modifications will be accommodated free of charge.

Notes to Inclusive Design Services:

  • Timescales will be dependent on the project in question and the quality of information provided.
  • Your Project Manager will be able to tell you what is required and when. Please make every effort to provide the correct information.

Net Contribution

Further and notwithstanding anything to the contrary contained in [this Agreement] and without prejudice to any provision in [this Agreement] whereby liability is excluded or limited to a lesser amount, the liability of [the Consultant], if any, for any loss or damage (“the loss or damage”) in respect of any claim or claims shall not exceed such sum as it would be just and equitable for [the Consultant] to pay having regard to the extent of [the Consultant's] responsibility for the loss or damage and on the assumptions that:
(i) all other consultants and advisers, contractors and sub-contractors involved in [the Project] shall have provided contractual undertakings to [the Client] on terms no less onerous than those set out in [this Agreement] in respect of the carrying out of their obligations in connection with [the Project]; and
(ii) there are no exclusions of or limitations of liability nor joint insurance or coinsurance provisions between [the Client] and any other party to [the Project] and that any such other party who is responsible to any extent for the loss or damage is contractually liable to [the Client] for the loss or damage; and
(iii) all the parties referred to in (i) above, have paid to [the Client] such proportion of the loss or damage which it would be just and equitable for them to pay having regard to the extent of their responsibility for the loss or damage.
